Jack Balkin's Legal Theory And Its Intrinsic Weakness

The present work proposes, through the deductive method, through bibliographical research, to study a new form of legal methodology focused on the interpretation of legal texts inspired by the author Jack Balkin. He is one of the representatives of the Critical Legal Studies Movement, who was willing to study and approach Derridean deconstruction within the legal sphere, with the aim of creating his own theory about a transcendental deconstruction. In this work, essential elements will be presented for understanding the author's theory. Firstly, we will discuss legal understanding, and then analyze the idea of legal coherence. To this end, Balkin's point of view regarding utopian legal neutrality and the importance of studying the subject during the moment of interpretation will not be forgotten. Next, the idea of transcendental justice will be addressed as an essential element for the author, as well as the nest oppositions, which present themselves as relevant tools for the act of interpreting a legal text. Continuing, the concept of deconstruction that moves in search of the transcendental value of Justice will be presented. Through this study, we seek to verify the viability and (in)congruity of Balkin's legal theory, seeking to demonstrate, from a critical perspective, the importance of valuing an autonomy of law that does not appear to be vulnerable in the face of political and ideological elements.
